GENERAL TERMS AND CONDITIONS

This agreement is made between the client (hereinafter referred to as "Client") and SportMarket Kft., with its registered office at 1031 Budapest, Őrlő utca 21. 2/6, Company Registration Number: 01 09 432963, Tax Number: 32603059-2-41 (hereinafter collectively referred to as "Parties") under the following terms and conditions:

 

1.GENERAL INFORMATION AND CONTRACT FORMATION

1.1 The contract is only established when the Client places an order through the website https://judobcknmbr.com, in the manner and under the conditions set out in these General Terms and Conditions (GTC).

1.2 The website's services may be used by individuals with full legal capacity as well as by authorized representatives of entities with or without legal personality, provided they have successfully registered using real and verifiable information when submitting an order and agree to be bound by these GTC. The Contractor shall not be liable for damages arising from false data submitted during registration.

1.3 Payment Provider:
I acknowledge that the personal data stored in the user account of SportMarket Kft. (1031 Budapest, Őrlő utca 21. 2/6) in the https://judobcknmbr.com user database will be transferred to OTP Mobil Ltd. (data processor). The following data will be transferred: email address, country, state, city, street name, and house number. The data processor’s privacy practices can be reviewed in the SimplePay Privacy Policy, accessible here: http://simplepay.hu/vasarlo-aff.

 

2. REGISTRATION

2.1 Registration may be completed during the order process by submitting all required data. Orders may be placed without registration, but certain services are only available to fully registered Clients.

2.2 The Contractor is not responsible for delivery delays or errors due to inaccurate or incorrect data provided by the Client. Clients are responsible for securely managing their passwords, and the Contractor assumes no liability if unauthorized persons access the password due to reasons beyond its control. Incorrect data or information related to active orders can be updated via the Contractor’s contact channels.

2.3 By accepting the GTC, the Client consents to the Contractor using the ordered product, including the competitor’s name and images of the product, for marketing purposes on the Contractor's websites and social media platforms. The Contractor agrees to obscure the competitor’s face in such marketing materials, which the Client explicitly accepts.

 

3. SCOPE OF SERVICES

The Contractor agrees to perform the ordered printing and related services to the highest quality achievable using available technology. The Contractor will only accept orders once all required information has been submitted by the Client.

 

4. SERVICE CONDITIONS AND COMMUNICATIONS

Upon successful order placement and payment confirmation, the Contractor will automatically send a written confirmation to the Client.

 

5. RECEIPT OF PRODUCTS AND CONFIRMATION

Quantity Check: The order will be considered complete when the Contractor has delivered the exact number of products ordered. Any quantity discrepancies must be reported at the time of delivery.

 

6. PAYMENT

6.1 Prices indicated in offers, confirmations sent via the online system, and Contractor invoices include VAT in accordance with applicable laws. The Client is responsible for paying VAT in addition to the base price. Offer and invoice prices are net unit prices and apply to the specified number of product units. Prices do not include packaging or delivery costs, which will be added to the final invoice based on the selected delivery and payment options.

VAT Payment Obligations:

  • EU-based company with a valid VAT number: 0% VAT
  • EU-based individual: 27% VAT
  • Non-EU-based company: 0% VAT
  • Non-EU-based individual: 0% VAT
  • Hungary-based company: 27% VAT
  • Hungarian individual: 27% VAT

6.2 Credit Card Payments: Payment must be made via the payment module during the order process. Card data is submitted directly through OTP Bank's platform, and the Contractor does not receive or store credit card information.

 

7. DELIVERY

7.1 The Contractor will deliver the final product to DHL within 10 business days after confirming the order’s feasibility.

7.2 Upon delivery, the Client must inspect the package and sign a receipt if the order is complete. No complaints will be accepted after this point. Any delivery issues must be documented in the presence of the delivery representative.

7.3 We strive to offer a seamless shopping experience, including an easy return and exchange process. For all EU customers (including Switzerland), we offer a fast exchange service within 10 days of delivery. For non-EU returns, please contact customer service directly for assistance.

 

8. LIABILITIES

The Client is responsible for providing all necessary information for the Contractor to complete the order. The Contractor assumes no liability for the content or validity of data in the Client-uploaded files. The Client is fully responsible for all intellectual property and rights associated with the work.

The Contractor’s liability is limited to the value of the work performed, and subcontractor performance quality is solely the Contractor's responsibility.

 

9. FORCE MAJEURE

In the event of force majeure, the Contractor may cancel, reduce, or delay orders without liability. The Client may terminate the contract only after four weeks of continued disruption.

 

10. DATA PROTECTION

The Contractor will handle personal data in accordance with the Terms of Use and Privacy Policy. All website users must comply with these terms.

 

11. VALIDITY OF TERMS

These GTC are effective as of 01.04.2024 and apply to all contracts made after this date. The Contractor does not send this GTC with order confirmations but makes it available on its website.

 

12. TERMINATION

The Contractor may terminate the contract immediately if:

  • Bankruptcy or liquidation proceedings are initiated against the Client.
  • Payment is jeopardized by the Client's financial condition.
  • The Client commits a serious breach of contract.
  • The Client's practices may harm the Contractor's reputation.

 

13. FINAL PROVISIONS

Matters not covered by these terms are subject to the Hungarian Civil Code (Act IV of 1959). Disputes will first be resolved amicably, but if unresolved, the exclusive jurisdiction of Budapest District Courts will apply.
